1. Definitions

In these Terms and Conditions:

• "We," "Us," "Our," refers to Solmaris, a yacht charter service operating from Phuket, Thailand
• "You," "Your," "Guest" refers to the individual or entity booking our charter services
• "Charter" refers to the yacht rental services we provide
• "Vessel" refers to the yacht chartered for the agreed period
• "Agreement" refers to the binding contract formed when you book our services

2. Acceptance of Terms

By booking a charter with Solmaris, making an inquiry, or using our website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.

You must be at least 18 years of age to book a charter. By making a booking, you confirm that you have the legal capacity to enter into this agreement.

3. Booking and Confirmation

3.1 Booking Process

Bookings can be made by contacting us via phone, email, or our website contact form. A booking is not confirmed until you receive written confirmation from us.

3.2 Deposit

A deposit of 50% of the total charter fee is required to secure your booking. The remaining balance is due 14 days before the charter date for day charters, and 30 days before for multi-night charters.

3.3 Payment Methods

We accept bank transfers in Thai Baht and major credit cards. Payment confirmation must be received before the charter date.

4. Cancellation and Refund Policy

4.1 Cancellation by Guest

• More than 30 days before charter: Full refund minus 10% administrative fee
• 15-30 days before charter: 50% refund of total charter fee
• 7-14 days before charter: 25% refund of total charter fee
• Less than 7 days before charter: No refund

4.2 Cancellation by Solmaris

We reserve the right to cancel a charter due to weather conditions, mechanical issues, or circumstances beyond our control. In such cases, we will offer to reschedule your charter or provide a full refund. We are not liable for any additional costs you may have incurred.

4.3 Weather-Related Changes

If weather conditions make sailing unsafe or significantly impact the charter experience, our captain has final authority to postpone, alter the route, or return early. We will work with you to reschedule when possible.

5. Charter Services

5.1 Inclusions

Charter fees include the vessel, professional crew, fuel for the planned itinerary, standard safety equipment, and provisions as specified in your charter agreement.

5.2 Exclusions

Unless otherwise specified, charter fees do not include: alcoholic beverages beyond those included in the package, special dietary requests requiring premium ingredients, docking fees at certain marinas, or gratuities for crew.

5.3 Itinerary

While we plan itineraries carefully, they are subject to change based on weather, sea conditions, or other factors affecting safety and guest comfort. The captain's decisions regarding route and timing are final.

6. Guest Responsibilities

6.1 Conduct

Guests must:

• Follow all safety instructions provided by the crew
• Treat the vessel, crew, and other guests with respect
• Not engage in illegal activities or bring prohibited substances aboard
• Comply with Thai maritime laws and regulations

6.2 Health and Safety

You must inform us of any medical conditions, allergies, or mobility limitations that could affect your charter experience. We reserve the right to refuse boarding to anyone who appears intoxicated or poses a safety risk.

6.3 Damage

Guests are responsible for any damage to the vessel or equipment caused by negligence or misuse. We reserve the right to charge for repairs or replacement of damaged items.

7. Liability and Insurance

7.1 Our Liability

Solmaris maintains appropriate insurance for our vessels and operations. Our liability is limited to the extent permitted by Thai law. We are not liable for:

• Personal injury or loss resulting from your failure to follow safety instructions
• Loss or damage to personal belongings
• Delays or cancellations due to weather or circumstances beyond our control
• Consequential damages including lost vacation time or additional expenses

7.2 Guest Insurance

We strongly recommend that guests obtain travel insurance covering personal injury, medical expenses, and trip cancellation.

8. Intellectual Property

All content on our website, including text, images, logos, and design elements, is the property of Solmaris and protected by copyright and trademark laws.

Photographs or videos taken by our crew during charters are shared with your permission only. You grant us a non-exclusive license to use guest-provided photographs for marketing purposes, unless you explicitly opt out.

9. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review our Privacy Policy for details.

10. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, governmental actions, strikes, or other force majeure events. In such cases, we will work with you to reschedule or provide a refund.

11. Dispute Resolution

11.1 Governing Law

These Terms and Conditions are governed by the laws of Thailand. Any disputes shall be subject to the exclusive jurisdiction of the courts of Phuket, Thailand.

11.2 Informal Resolution

Before initiating formal legal proceedings, we encourage you to contact us directly to resolve any disputes. We are committed to addressing concerns in good faith.

12. General Provisions

12.1 Entire Agreement

These Terms and Conditions, together with your booking confirmation, constitute the entire agreement between you and Solmaris.

12.2 Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full effect.

12.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

12.4 Assignment

You may not transfer your booking to another party without our written consent. We reserve the right to assign this agreement to another entity.

12.5 Notices

All notices should be sent to the contact information provided below. Email notices are considered received when sent to the email address you provided during booking.

13. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website with an updated "Last Updated" date. Bookings made before changes take effect will be governed by the terms in place at the time of booking.

Continued use of our services after changes are posted constitutes acceptance of the modified terms.
